Brazil Appoints New Head of Gambling Regulator

The Brazilian Secretariat for Prizes and Lotteries (SPA) has a new leader in the form of Duderna. This appointment places Duderna in charge of overseeing the regulation of gambling activities within the nation. As per the official publication of the Brazilian Federal Government, Duderna will assume the role of head of the SPA, a position bestowed by the Chief of Staff of the Brazilian Government, Rui Costa. Duderna’s background includes expertise in regulatory and public law, having previously served as the legal manager of the National Association of Rail Transport (ANTF).

The SPA, a branch of the Ministry of Finance, is tasked with formulating the regulatory framework and issuing related rules. Prior to Duderna’s appointment, the agency lacked a head, with Simone Vincentim serving as the deputy secretary. Duderna’s professional connections include a close relationship with Dario Durigan, the executive secretary of the Brazilian Ministry of Finance, with whom he collaborated during Dilma Rousseff’s term as president.

Duderna’s new position will oversee the regulation of gambling activities in Brazil. Brazil is currently in the process of regulating its gambling market, following the enactment of Law No. 3626/2023 by President Luiz Inácio Lula da Silva in December of the previous year.

Over the last seven days, the Brazilian Ministry of Finance, in conjunction with the Sports Betting Regulatory Agency (SPA), unveiled new rules governing gambling, specifically Normative Resolution No. 615. These new regulations include a stipulation that betting operators are prohibited from accepting wagers via credit cards or digital currencies.

Brazil is currently in the midst of a four-stage regulatory implementation process, projected to be finalized by the end of July 2024. The initial stage, which is presently in progress, aims to establish payment, security, and technical frameworks.

The subsequent phase will involve the SPA disseminating its policies on fraud, encompassing anti-money laundering and anti-terrorism financing tactics. The third phase will concentrate on advertising procedures, along with technical and security aspects. Lastly, the final phase will focus on how the industry can contribute to social responsibility initiatives.

The Ministry of Finance will oversee the regulation of sports betting advertising.
Earlier this year, in April, Brazil also declared that sports betting advertising must adhere to the Ministry of Finance’s regulations.

The Brazilian Football Confederation (CBF) General Competition Regulations for the 2024 edition specify that advertising must comply with guidelines, such as prohibiting advertising by unauthorized operators.

Unfounded claims related to winning probabilities in advertising are also prohibited, as are marketing campaigns that promote gambling as a solution to financial difficulties or as a socially acceptable leisure activity.

Its also against the rules for operators to use famous people or other influential individuals to advertise gambling products.
